Strategic Contracts – Draft Conditions of Contract

Australian Antarctic Division (AAD) strategic contract procurement refers to the contracting of goods or services, including consultancies and professional services; construction; maintenance and material supply contracts; facilities contracts and capital equipment, undertaken by the AAD for its own consumption.

The Financial Management and Accountability Regulations outline the fundamental policies and principles that underpin AAD strategic contract agreements. They articulate the expectations that exist on officials, or agents facilitating strategic contracts on behalf of the AAD.

The AAD ‘Strategic Contract – Draft Conditions of Contract’ will assist potential and existing contractors and suppliers to the AAD in understanding the strategic contract management requirement.

General

The ‘Strategic Contract – Conditions of Contract’ are the basis for agreements entered into by the Commonwealth of Australia, through the AAD issuing a formal contract to a nominated supplier or contractor. The ‘Strategic Contract – Conditions of Contract’ will prevail in any conflict between the AAD and the Supplier or Contractor in relation to the Contract.

The ‘Strategic Contract – Conditions of Contract’ may include any written ‘Special Conditions’ which will prevail in the event of any inconsistency.

The attached ‘Strategic Contract – Draft Conditions of Contract’ may vary from contract to contract and should be used as a guide only.

Of particular note is the AAD Environmental Purchasing Guide and AAD Environmental Policy, which indentifies AAD environmental contracting considerations. It is essential that all suppliers or contractors to the AAD familiarise themselves with these requirements.
